We reserve the right to refuse service to anyone for any reason at any time. You understand that your content may be transferred unencrypted and involve transmissions over various networks.
All services provided by Fexa Digital require payment as agreed upon in the project proposal or contract. Payment terms are as follows:
A 50% deposit is required before work begins on any project.
For larger projects, payments may be structured around project milestones.
The remaining balance is due upon project completion and before final delivery.
Late payments may result in suspension of services. All fees are exclusive of any taxes, levies, or duties imposed by taxing authorities.
Fexa Digital respects intellectual property rights and expects the same from our clients. The intellectual property provisions are as follows:
You retain ownership of all content, data, and materials you provide to us.
Upon full payment, you receive ownership of the final deliverables.
We retain ownership of our proprietary tools, frameworks, and methodologies.
Third-party assets used in your project may be subject to their own licenses.
To the fullest extent permitted by applicable law, Fexa Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
Our total liability for any claims under these Terms, including for any implied warranties, is limited to the amount you paid us to use the services.
We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use our services will cease immediately. If you wish to terminate your account, you may simply discontinue using our services. All provisions of the Terms which by their nature should survive termination shall survive termination.
These Terms shall be governed and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
